Private body particulars

Purpose of this page

The Promotion of Access to Information Act 2 of 2000 (PAIA) provides a process to request records of a private body where the record is required for the exercise or protection of a right and the legal requirements are met. POPIA also provides rights to access and correct personal information.

Records held

Applicable legislation

Records may be held under laws including PAIA, POPIA, the Electronic Communications and Transactions Act, Consumer Protection Act, Rental Housing Act, Companies Act if applicable, Income Tax Act, Value-Added Tax Act if applicable, Basic Conditions of Employment Act if applicable, and other legislation relevant to the operator's activities. Counsel must confirm the final list for the operator's legal form.

How to request access

  1. Use the prescribed PAIA form for a request to a private body or clearly state that the request is made under POPIA.
  2. Identify the requested record with enough detail to locate it.
  3. Explain the right you seek to exercise or protect and why the record is required.
  4. Provide proof of identity and authority if acting for another person.
  5. Send the request to the Information Officer email above.
  6. Pay any fee lawfully prescribed after receiving notice that it is due.

Grounds for refusal and third-party rights

Access may be refused or limited where PAIA permits or requires it, including to protect another person's privacy, confidential commercial information, safety, security, privileged material, research or legal proceedings. RentSignal may notify affected third parties and will provide reasons and available remedies where required.

Information Regulator guide and remedies

The Information Regulator publishes a guide and prescribed forms at inforegulator.org.za. A requester may use the complaint and court remedies available under PAIA and POPIA.
